this is true.. the operative phrase is. "WITH PROOF". doing mods before the warranty is up is a serious "you rolls the dice and takes your chances"
The explanation given by the dealer whether truth or lies again the onus is on you to prove their lie.

That means a third party mechanic that can testify as an expert witness in a civil court room against Fords army of techs and lawyers. Even if you win, you still lose.

You only win against a dealer with a weak bluff or the money to go the distance and throw away.

As I said before, naive.

I didn't say the situation is right, just the more probable end result.

At least lemon laws work because the proof you need is actually created by the dealer every time the vehicle has to go back for the repair. They can't fight lemon laws because their own records are the evidence against them. lol

You guys have to realize the dealer DOES NOT make decisions on what is or is not covered under warranty, Ford does. Minor things it is a matter of course that these items are approved. But, for something major the dealer can't proceed without approval from Ford. Ford may approve if it is an issue they are aware of or they may require the dealer to do some level of diagnostics. If Ford denied the claim the dealer is out of the loop and you are then left with arguing with mother Ford.

Yeah but once I'm standing in front of them with my arms crossed and I utter the magic words " I Have a lawyer!!!" , things will change and they will bow down before me and cave to my demands... won't they ?

What you describe is what people actually think often.

The reality is once you bring "lawyer" up the next person you are likely going to have open conversation with is Ford's lawyer. You are basically threatening a low level peon on the ladder (that counts even the GM of the dealership) who generally know they aren't law savy (hence they work at a dealership...) - so the basic response "Well I don't know about that, you'll have to contact the Ford Lawyers Division".

I've been personally threatened with being sued and my response was instant, "Well ok, have your lawyer contact my lawyer".

No one contacted my lawyer. And I am not a big dealership or corporation, just some guy who works a job that pays me peanuts.

No they won't. They will hand you a phone number to Fords Customer Service and tell you to take it up with them. Once Ford has denied the claim it is out of the dealers hands. It will be in the computer against your VIN so taking the vehicle to another dealer won't make a difference.

In a previous life , long long ago , I sat in on most Cadillac warranty claims at the dealership I was at , Let's just say "Entitlement " is nothing new here , and Cadillac ALWAYS won when it wanted too , Doctors , Lawyers and local politicians be damned...

Different than what I mentioned before, as a cop I get threatened to be sued at least a few times a month. My generic response is usually, "Make sure they spell my name right on the paperwork" or "No problem, here is my business card, pass it on to your lawyer".

Keep in mind, generally the threats are coming from people who probably couldn't even spell lawyer to look one up on Google.

The minute you mention "lawyer", all bets are off. As others have said, dealer automatically refers you to Ford corporate. Most "regular" lawyers won't even take a case involving auto manufacturers over a warranty claim, and those that will, well, you can't afford them. You will be paying much, much, much more hiring a decant lawyer than you will ever pay for your repair.
And, all the while, your vehicle is in limbo, sitting, unless you pay upfront for the repair, hoping to get money back from the manufacturer.
My son is an attorney and I ran this past him. Although he is a patent attorney, only working on patent law and patent infringement, he is familiar with these types of claims. Said he dosen't know one firm or lawyer that would take a warranty claim case, and those that would would cost big $$$, or on the flip side, you'd find their advertisements on bus benches.

When I was a manufacturer rep as soon as I was threatened with an attorney I quit speaking and provided the HQ phone number. Sometimes it was a blessing.

Just a quick reminder; Any dealership can refuse service to you. They are not obligated to service a customers vehicle, even if it's 100% stock.

So warranty, pretending to be a lawyer... Don't mean **** when the service writers tell you to go kick dirt when they see something they don't want to get involved in. They have thousands of other customers.

Basically, in a nutshell, the dealer would have to prove that any modification you made was the direct cause of the failure to get out of the warranty.

That being said... They do have all of the trained and certified mechanics and technical specifications to they get an upper hand in court.
