They are not going to release it until recall is completed. A second year law student could win that one. Ask for an acceptable vehicle to drive until released.
Yes, if you brought your truck in for an issue they should give you a loaner while you wait. I don't see why this would not apply for this situation as well.

When my truck was brand new and the lower seat latch did not release, blocking access to the jack handle, I removed the 4 bolts holding the rear seat assembly in, dropped it off at the Ford dealer and went camping in Arches.

Came back and dropped the truck off for a couple hours to install the repaired seat release.

I would think you could sign a waiver releasing them of responsibility of injury if you use a child seat (since you know you won't) an agree to bring it right in when the repair part is available.
This

It takes the liability off of Ford and the dealer. When they get the parts, you bring it in.

This happened to my buddy with a Mustang GT. They wouldn't release the car until the brake pedal recall was done and of course, the part wasn't available.

He just found another one.

Yes the title is already in my name, I only have payed some down payments. The financing is on hold due to this situation. I even received the welcome emails from Ford.
Are you leasing or borrowing?
What “title” document do you have?
Did the dealership arrange the transfer of ownership/registration before it was paid in full?

Part of the issue is that there is basically no vehicles available that suit my budget / requirements on the lots here in Canada. I found this truck on the lot which one another big factor on why I pulled the trigger. I am sure they will cancel the deal no problem, but that still leaves me with out a vehicle and just on a different waiting list.
Ask for a free loaner?

Wow, I guess the dealer that I used screwed up. I took my truck in last week and left it for a day and a half for both recalls. The seat belt was fine, they needed parts for the child restraint recall. I didn't ask what parts but they told me that the parts are on back order and they would call when they came in to complete the recall. I'm driving the truck.

You have a title, do you have a key?

Guaranteed that truck is parked at the back if the lot somewhere. Get a ride to the dealership during business hours and get your truck? Are they gonna call the cops on you for stealing your own truck?

If not howabout calling your local PD on the non emergency line? See if they can have an officer meet you there. Show the officer your title and ask if he can demand your truck be returned.

It's worth a shot.

This is theft pure and simple.

I would say if they truck is sold you and the papers are complete, and they held it right before you would have driven off, I would think they own you a loaner at least. In many US states if they hold your vehicle for over 30 days you quality for lemon law on it and since it has not been driving should be able to get 100% of you money back, if your country/area has a similar law.

And it's not theft as some keep calling it. There are laws (likely resulting from liability lawsuits in the past when a buyer drive off in an car/truck with an open recall and got injured) that makes it illegal for them to release a car/truck with an open recall. Same thing happened to the RS in early 2018, any unsold car affected by the head gasket recall became unsellable by the dealer until the recall was performed. Luckily most, if not all, of the buyers that has special ordered cars affected had already received them so only the dealer stock with crazy markups were there long enough to be affected.

Also, if you don't have the key you could take your title and key code to another dealership, get a key made, and then go get your truck.

It'll cost you a bit. But you'll have your truck.

This happened with several Bronco owners with the airbag recall and because of the safety recall they (the dealer) can not release it. Yes it's odd because many others have theirs and are driving them but unfortunately that's how it works. There are a few threads on this so it's common practice.

I’m having the same issue. Bronco arrived at the dealer October 21 or so and while I was at dealer to pick it up was told they can’t release the car due to the airbag recall.

This poor guy has had his built since July and as of this post (Nov 3rd) it's still sitting.

So my Rig show's up at the dealer and I go to look at it. The dealer said there is a stop order on it for an airbag recall and I have to wait till it is replaced. I asked when it would be and said Ford told him they would send him the info by the end of the year. Keep in mind my Bronco has been built since July and is a dirt Mountain Bronco.

Yep. Completely agree. At this point they should either 1. Give you the truck or 2. Give you all of your money back. Anything else and I would be getting a lawyer involved.
The third option is to give you a loaner. I would have expected the dealer to have offered that up front.

It makes perfectly good sense to me that they can't sell a vehicle with a safety defect. But here's the part the confuses me: they did sell the truck to OP. They took his money and transferred title to his name.
