I already posted this in reply #20, but here is the pertinent point directly from the Ford Extended Warranty of what is not covered.Remember that even the Ford Performance Tune is technically still a Aftermarket Tune no matter how you look at it. Being Ford Performance it is considered approved by Ford, but not necessarily approved by Ford Extended warranty. If you read the fine print of the extended warranty then it will tell you if it will cover the powertrain or not with an Aftermarket Tune (yes that means the Ford Performance Tune as well).
Even the Ford Performance Tune states the Factory Powertrain warranty is Downgraded(not to be confused with VOID) to 3/36 instead of the 5/60 going off of the original purchase date of the vehicle(first owner of vehicle).
This is from the Ford performance site:
FPP is the ONLY one approved by Ford, when installed by a certified or authorized tech, so according to the above won't void the warranty. The gray area is when it states, 'will not void you New Vehicle Limited Warranty', which we know is 5/60. My understanding is the 3/36 is for the tuning device, not the vehicle. Trying to get someone to clarify that is like putting socks on a rooster.
Now the dealership or Ford can try to deny it, and the question will be how willing you are to fight for it.
