Ford / Dealer will not release my Ranger due to recall

It makes perfectly good sense to me that they can't sell a vehicle with a safety defect. But here's the part the confuses me: they did sell the truck to OP. They took his money and transferred title to his name.
That sounds like a dealer mistake. Not sure why the dealer isn't giving the OP a loaner for all this hassle.

Guaranteed that truck is parked at the back if the lot somewhere. Get a ride to the dealership during business hours and get your truck? Are they gonna call the cops on you for stealing your own truck?

Good and bad IMHO.
  • The good, @Khalinatek now owns the truck, which I think will give him precedent over dealer stock units once the updated headrests start arriving. Nothing from Ford or my dealer when they expect to have them- I'm waiting, too.
  • The bad, his warranty clock is running.
  • The ugly, Ford and the dealer don't owe you a thang except the recall fix: A loaner appears to be strictly good will, not obligatory. I would try to find out who made the stop delivery call (the dealership? The Zone/Region management? Ford Motor Company?) and find out exactly why your truck can't be release to you while there are thousands on the road now with the "sub-standard" headrests & seatbelt hardware. Your warranty should be post dated to the day you actually take possession of the vehicle, and I would keep going up the chain of command until it is.

Could be related to Khalinatek's hold?

"The affected models were all built at Ford's Hermosillo plant between October 6 and 20, 2021. The precise problem appears to be rear seat belt anchorages whose tapping plates were manufactured with oversized extruded bolt holes that attach to the rear seat belt buckles."

If his financing is "on hold" and he's only making some "down payments", then he is not the owner of that vehicle free and clear. Dealer still owns it.

There's a financing company of some type involved and the title is not in his name alone. So he's only maybe on the title with the leinholder, whoever that may be.

The dealer taking money from him on a regular basis sounds a bit iffy to me, though, but I'm sure there's a reasonable explanation for that and I'd sure like to hope the dealer has made it clear why this is happening.

If the financing isn't done, it's not his truck yet. Who has the keys? If Ford has control of the vehicle they will not release it with an open recall, especially a baby seat anchor. Can you imagine the headlines if they let someone drive that off the lot?

LET OP HAVE TRUCK ANYWAY!!!!"

Should the dealer undo the deal? I think so if only as a matter of goodwill. I mean, they will sell the truck to the next guy in line once it's fixed so no real skin off their bottom line.

Khalinatek: if the financing is on hold, you don't have an active loan to make payments to.

The car loan business is full of fraudsters. I smell A fish or two (dealer and loan company).

Contract law " usually requires an exchange of goods for money (this for that).

The Basics of Contract Law
A contract must contain consideration. “Consideration” means something of value, which is usually money, bargained for in exchange for the product or service that is being offered.

A letter from a lawyer might get your car or money back.

Let me add some more detail to make sure I'm stating it all clear.

In October I was told hey your truck is all good to go, just go ahead get insurance on it and come in this week to get it. So I went ahead and got that all sorted, the insurance company contacted the dealer and got it insured. (I have canceled this now)

The day or day before (I cant remember), I was scheduled to come get the truck I was informed about the safety recall. Therefore I did not go into the dealership. I assume that the title must be in my name by this point, however yes with a lien holder on it since I am financing.

So the truck is sitting in the dealers lot, they have all the keys and paperwork. I assume the last step is completed at the dealer ship which starts the payment cycle. So no gone in 60 seconds heist for me lol.

The current market is so bad that if I take my name off this truck I will be in an even more truck-less scenario. There doesn't seems to be another Supercab XL trim in the whole country. Right now in Canada, a 2019 with 50-60K Kms on it is the same price as a new truck. Leaving my down payment on it secures the vehicle. The dealer said I can cancel it if I want, but that's just getting me out of their hair. Right now getting the vehicle is much more important to me than getting my down payment back.

If my daily didn't just die, I would have just continued waiting, but this puts me in a crappy spot. Sadly I think you are right and I am screwed. I will try and to get a "good-will" loaner. Otherwise I think I'll be stuck waiting.

What little I know about car sales is;
1. The manufacturer issues a certificate of origin with each new vehicle. This is not a title and the buyer does not get it.
2. Once the vehicle is sold paperwork including the certificate of origin are provided to the state and the state issues a title to the owner of the car.
3. Unless you finance with a personal loan the bank providing the loan places a lien on the title with the state. No title will be issued to the owner until the loan is paid.

The OP has likely signed a sales agreement and placed a down payment. Sounds like he has been approved for a loan but since he has said the loan is on hold I would say the transaction is not complete and the vehicle is not yet legally his.

Clearly the thoughts and opinions of members here are not going to resolve this issue.

Your last post sums up your interest or stake in this matter. You have a down payment, and have a claim to the vehicle.
