The ATF ruling states that the waived fee for the tax stamp only applies to completed firearms. You cannot slap a brace on a pistol lower, register it now and avoid the fee. This is so that people aren't registering the thousands of unbuilt pistol lowers sitting around in garages accross the country.
No brace, just a buffer tube is still perfectly acceptable to the ATF.

If you bought a lower receiver with factory installed brace then you need to pay the tax stamp. If you bought the parts yourself and completed the build you DO NOT have to pay the tax stamp. So you can slap a brace on a lower to avoid the fees.

So basically just slap on a 16" upper and wait until the courts decide this mess. Should be a no brainer and turned around soon enough.Me too.
And the legalese makes it difficult. But I believe the phrase "as the exemption is only applicable to already completed firearms" clarifies the meaning to be that you can't avoid the fee on registering a "naked" lower with brace.

I watched a video where an FFL fellow stated that there are ~40 million weapons affected by this ruling. ATF gives a deadline to register by. ATF has 81 day grace window once application is sent in. If they do not approve application in 81 days then you are SOL and in violation! So by attempting to register your once legal weapon, the ATF will have all the info they need to come knocking at your door to retrieve the weapon, fine or send you off to the pokey. And sense you are now charged as a felon, confiscate any other arms found.
The fellow thinks it is nothing more than a "honey pot" pretext for a gun grab.
I am only reporting what this fellow had to say. I don't have a dog in this fight as I don't own one.
I've standardized my weapons of choice, and it didn't make the list. (sigh) 22, 380, 40, 556, 12 & 16 gauge. Looking back 9mm might have been a better choice than 40, but that ship has sailed. And I prefer 16g over 12g as I get older. It is hell on an old man's shoulder, even with a stock pad!
I do know that he is correct on this one count. There is no way the ATF can process 40+ million applications within the grace period, and mostly likely not single applications in 81 days if they are swamped. Do the math.
