Yeah, probably needs an exhaust extention. Kids are exhaust port level on a bike too. Just a different type of gas fumes being expelled.

Ask yourself, would you rather have your kid behind you on a seat or 6" off the ground when that Pit Bull comes charging after him? ? ?There could be a bungee cord holding the kid in the milk crate, probably sturdier than a kids bike seat.
And 6"-8" seems safer than a few feet off the ground.
