In shocking news, Mountain Dew soda does not contain dew from a mountain. Muh damages.

I think I also recall a story about Redbull having to drop their original motto "It gives you wings", because you know, it didn't actual make you grow wings. It might have been a National Inquirer report, but I seem to recall it being legit.

Only one entity pays for these actions at the end of the day and it ain't the manufacturers.

Normally I would totally agree with you - there are WAY, WAY, WAY too many frivolous lawsuits. This one though seems legit to me. The manufacturer was attempting to use deceptive marketing to try and expand their sales. The bad part is that it will most likely end up as a class action suit and people who fell for this stupid marketing will get almost nothing while the lawyers rake in millions.

ive seen these. they say right on the label malt beverage. i think its more plan to get money than a misrepresentation. of course it looks like the fireball booze label. no one would buy them without the company recognition. nike would not give up the swoosh. a dollar drink from skanky gas stations is not gonna be a real spirit. even the "real" fireball is barely whisky lol. the tort was started after the lady realized the dollar she spent on fake fireball meant she could not afford her virginia slims until after the next client...

In Va, they can't sell whisky in convenience stores. All liquor is sold at ABC stores. So there has to be some fault on the purchaser if he thinks he is actually buying whisky.

Today’s award goes to number 9. This lawsuit needs to be flushed. The packaging for Dulcolax laxatives says the product “works naturally” to help you go to the bathroom. A lawsuit claims the Dulcolax packaging takes advantage of consumers who want an all-natural product. They say customers lack the ability to test whether Dulcolax is natural at the point of sale before they buy the product.

No the real sad statement in that article is that for every 1 case dismissed, 10 are settled because its cheaper than taking it to court to get it thrown out.

I swear, if I owned a company, having "fuck you" money would fall in the same category as renting a yacht. It would be part of my entertainment fund and going to court to smash these cockroaches would be welcomed.

Girl Guides in Canada recently changed the name of of one of their sections from "Brownies" because some people claimed that "the name caused them harm and prevented or delayed their decision to join." Never mind that these idiots had obviously never looked into the history of the name, otherwise they would have realized that it was made up and had to do with fairies, and never, EVER had anything to do with race.

Too many people today are looking for a reason to complain about something, and any damn thing will do.

While I wholeheartedly agree with you, going to court runs the risk of the judge being just as stupid as the plaintiff; look at the judge who agreed with the women who sued McDonald's because their coffee was too hot, causing her to burn herself because she was driving with the coffee held between her legs instead of in a fucking cup holder. Never mind the bitchy little plaintiff, that idiot judge kicked off the whole trend of frivolous lawsuits which have plagued the justice system for the last quarter century, only making lawyers richer for being greedy little assholes ready to make a buck off of stupidity.

Ideally, lawyers who take on too many lawsuits which are deemed frivolous by a judge should be disbarred. Maybe making the lawyers risk their own livelihood would finally stem the flow of this crap.

Well the first problem is you clearly don't know anything about that case but what you heard second hand.

I suggest you go read that case. In that event the victim was completely justified in the lawsuit.

Edit: I'm not being mean, just blunt. The McDonalds case seems to be the "go-to" when frivolous comes up, but I have rarely encountered a person who actually knows what the case was about. They just heard from a friend it involved some woman spilling coffee and winning a bunch of money.

You're right, I haven't studied that case, and frankly, I don't have the time to sift through a bunch of legalese to figure out why an x00-page document could probably be reduced to 2.

Can you give us the Cole's Notes as to why she was justified? Am I wrong that she was driving with the coffee in her lap? On that alone, I say that she should be responsible for her own stupidity, but again, correct me if I'm wrong.

The coffee machine was malfunctioning and she received more or less a cup of boiling water. Yes she spilled it on herself, however coffee at standard heating temperatures would not have left third degree burns all over crotch.
