The firearm doesn't at all change the situation, it just adds to the seriousness of all the charges the young man is facing, I think. Perhaps he wasn't allowed to have a handgun because of his age...I don't know. But in this day and time the hot tip for the media is to be sure to include the presence of a handgun or other firearm so that they can have the opportunity to demonize the weapon and the person with the weapon.

It looks like the real weapon was whoever or whatever caused the truck to do this (most likely not even in the vehicle).

I do know people who have had U-Haul install trailer wiring on their cars and do a hack job, causing eventual shorting out of the ABS module, and the dash lighting up like a Christmas tree, but mechanical brakes were still available.

My suspicion is it may have had something to do with whoever set up that rig for towing.

him having a gun in the truck likely secured his fate in the media eyes as guilty. I hope he gets a fair shake. if hes guilty i want him to get the max sentence. if it really was a mechanical issue i hope it comes to surface.

Did anyone else notice a trailer brake controller either wasn’t hooked up properly or being used?

Doubt both the truck and trailer brakes failed at the same time.

Actually, at least in GA, and probably in other states, if it is an unintentional killing of someone with a vehicle, it is sentenced as a misdemeanor.

We had a school teacher clobber a car load of people up here in northern GA and her lawyer managed to get her charge dropped to a misdemeanor vehicular homicide, she walked with time served and probation.

" (c) Any person who causes the death of another person, without an intention to do so, by violating any provision of this title other than subsection (a) of Code Section 40-6-163, subsection (b) of Code Section 40-6-270, Code Section 40-6-390 or 40-6-391, or subsection (a) of Code Section 40-6-395 commits the offense of homicide by vehicle in the second degree when such violation is the cause of said death and, upon conviction thereof, shall be punished as provided in Code Section 17-10-3. "

17-10-3 Describes punishment for Misdemeanors.

Again, this is GA law, not applicable in the state where this happened, but lots of states have similar statutes.

imagine though, how hard a lawyer will try and turn the events to force this as an "intentional" act

At the risk of breaking the rules here, the offender and victim aren't the right narrative for the media to stay on this story. Another week and you probably won't see a whisper on it. Spade is a spade, it is what it is.

Regardless of media coverage, this is a sad story and one that hopefully resonates with many.

Kid admitted to working in vehicle safety systems, yet illegally modified his truck and presumably had no trailer brakes.

Not sure if the parking brake was even hooked up, looks like the booking says “failure to maintain at least one working braking system” or something along those lines.

My guess is nobody from the parade inspected the truck and trailer, the trailer was loaned, and never checked for safety. Kid probably knew what he was doing was dangerous, along with the questionable mods on the truck, as he’s been stopped multiple times in the past year for violations.

If this were my kid who died I’d be furious, I smell a case for subrogation involving the builder of the truck (maybe it was the driver, who knows), the parade staff, and the director of safety (if they even had one).

More than likely a case of “gotten away with doing risky things in the past, what could go wrong this time”?

If it doesn’t feel safe, smell right, pass muster, yet everyone thinks it’s ok (or lacks the common sense to check), then everyone involved should be questioned in court. At least that’s how I see it.

sadly true. i dont think you have broken any rule in stating the truth about the bias of the media. if this sad event had involved one of the medias hot to push topics we would be hearing of it non stop. so far this is the only place ive heard anything about it. ?
