I will bet you they aren't really checking the trans fluid, as to do that properly would require it to get to temp and someone probably burning themselves getting the OEM dipstick out while hot. I know they probably check that off their list, but I would be shocked if they actually do it.
We owned two of them and they were actually pretty good cars for us. We didn't drive them a ton of miles though (< 100k), which is probably why we didn't have any issues. They certainly didn't seem to be built for the long haul - lots of plastic.

Mine has done one or two hard shifts when it is really cold - it has done that since it was brand new. I don't worry about it and just take it easy until the trans has warmed up a bit.
Edit - "really cold" for around here is under 40. So pretty much anytime it is below 40, I get one or two...
