What is this black piece of plastic above my brake pedal?

This is a 2-piece duct that comes from the HVAC box assembly (this section) of the duct also includes the driver's footwell discharge temp sensor (not shown) - so this section cannot simply be removed due to that sensor, and the only solution is to trim it down - like this owner did and in the end if this generated any kind of recall - this would be the solution anyway only a professional designed (molded) look.
are a few that have the issues with the duct (toes hitting it)
