Can Ford tell who's tune has been loaded?

Yes. The warranty begins from date of first service.
Not sure what you mean. But to clarify the FP tune warranty covers the car during the cars first 3 years or 36 months not from the mileage/time that you install the tune.

So if you buy the car and it has 5 miles on it and you immediately install the tune you would be covered for three years from the date of sale or to an odometer reading of 36,005 miles. If you installed the tune after you purchased the car when it had 30,000 miles on it then you would have 6,000 miles of coverage.

Also, the FP tune does not shorten the power train warranty. The 5/60 power train warranty becomes just like any other after market tune if you have a failure and it is determined to be caused by the tune the claim could be denied but the next failure may be covered. That being said I have never heard of anyone having a power train failure in in the 5/60 portion of the warranty denied because they have the FP tune.

That's what I said. Didn't make the distinction about being a second owner though.

And it is pretty clear to the point that they put it in bold that your warranty stays intact for any failure not caused by the FP part. I would take anything you are told by the FP customer service folks with a grain of salt.

e) Failures caused by: (1) alterations or modifications of the Vehicle,
including the body, chassis, or electronic components, after the
Vehicle leaves the control of the manufacturer (2) any part
designated for “off road only’’ that is not installed by the
manufacturer, including, but not limited to, lift kits, oversized
tires, roll bars, and performance enhancing powertrain
components; (3) tampering with the Vehicle or the emissions
system and components; (4) installation or use of any mechanical
or electrical part not approved, certified or authorized by the
Vehicle’s manufacturer or any Failure caused by after-market
(non-factory approved) PCM reprogramming.

so if I'm understanding correctly by this "legal jargon".......if my motor/trans in my NON-ASE Ford Performance Tuned Ranger Lariat Tremor takes a dump at 100,00 miles my Ford extended warranty will probably deny it even if it's not the fault of the tune install "because they can"........BUT......if the a/c system takes a dump at 100,000 my Ford extended warranty probably should cover it??!!........even though technically Ford would have to "prove" the tune caused the failure (of the motor/trans) (which they will say no matter what to get out of a big ticket item like a motor/trans and you can't fight Ford)......

again, I didn't buy the extended warranty for the motor/trans but more for the other stuff which still can break and add up to thousands of $$$.......I'm not too worried at all about the Ford Performance Tuned motor/trans because it seems to be able to handle it and has a great track record.......

I had a 2019 Mustang with the Ford Performance tune that I had installed myself. About 1.5 years later, I had a head gasket failure. It was covered under the power train warranty and there were no questions asked about the tune from either Ford or the dealer but your mileage may vary.
