First let me pre-face this by saying I like HoAs. The caveat is they are run by decent people. It is a neighborhood you willing join in contract for some specified rules in exchange for some security in keeping property values stable by not having hoarder Bob with 6 cars on cinder blocks in his front yard. It also adds some level of uniformity. Falls into broken windows theory in some regards.

With that said, I find great enjoyment in being challenged by them and stopping them dead in their tracks. One such incident is when I had a street legal dune buggy (registered and plated) and they told me it was considered a recreational vehicle that had to be parked behind my house. Negative ghost rider, it is a registered and insuranced on-road legal vehicle. They tried to push it and I asked them if a Jeep with its roof removed and all doors removed fell in the same category. The contact from the HOA ceased after that. That rule has long since been changed.

In another incident (3 actually in close proximity) I had trees fall from the neighborhood green space and damage my fence. The same section of fence three times over 1 year. What are the chances? I observed the first tree appeared to have rot. Act of God, so I took care of it. I paid for fence and they paid for the tree removal. I advised them of the rot. Second one came down. Same thing, looked rotted. I then asked them to pay for everything. They refused. I asked when was the last time they had the greenspace inspected for trees that needed to be addressed due to rot since last being notified of the possible problem. They paid the total bill. They also paid the total bill the third time.

And now my most recent inquiry after I received a letter asking why a portion of my fence was missing;


HOA Police: Why has part of your fence been down? You need to repair it.

ME: Because I am adding a building to my back yard and doing fence maintenance & drainage repair because Keystone hired crappy/lazy landscapers when they built the lot. I took it down for access.

HOA Police: You have to file a request before you can build that. We don't have anything on file.

ME: *sends them an e-mail that shows HOA approval on an unspecified sized building to be placed in backyard from May 2020*

HOA Police: Oh... uh, ok.

Cliff Notes: The HOA granted me a blank check.

I guess the person in charge of HOA modification request changed at some point ), or the process on how it is done (an actual form on letterhead) was changed at some point. Clever person I am, I sent (by their directions) a request by e-mail to build a metal building in my back yard over a year ago. I purposefully excluded any dimensional information or specific details, only that it would be metal and match (or close similarity) to my home. They approved it with no further probing. I made sure to store that e-mail on my back-up drive. LOL

That would get me a visit from my county's finest I'm sure. haha

I wouldn't do that to my neighors. They are the best neighbors one could ask for. We even talked about adding walk through gates on our back yards to each others yards.

At least you've got adults on the board that are willing to reverse course when they stray.

Mine is so bad I have a law firm on retainer and have a different (beautiful) piece of property for sale to avoid that HOA's president who is also my local Vice President!

What are the chances I'd buy a lot to build on 500 miles from home, find I share that community with both a good neighbor, and a power hungry member of the HOA Gestopo??

I agree that in theory they aren't bad. But in practice? They're usually miserable.

We had a late freeze last spring, 2020. Lost one of our trees. It had a good sized new sucker sprouting so I was contemplating letting the tree give it another go. Got our notice letter from the gestapo so we replaced it, the right way. Ground the stump and replaced at a cost of almost $1000. We didn't just chop the old one down and park a home depot tree next to stump like many did. The HOA was obviously OK with our solution.

So this summer I get a violation letter related to the trees. It's an ongoing issue that many haven't resolved. I was a bit taken aback so I reached out. It is impossible to get a person on the phone there and their voice-mail says they only return emails on Wed, and Fri? WTF?

Here is our email exchange.

The violation was for dead/dying or missing tree: missing tree lawn tree.

I do not have any dead/dying or missing trees on my tree lawn. I have 2 trees on my tree lawn, the same as the day the builder landscaped it. Last year we lost a tree in the spring storms, recieved a violation and replaced the tree. We sent you pictures and the matter was resolved.

The picture included with the violation doesn't even depict my lawn or trees well. It is a diagonal shot from in front of my neighbors house.

Please advise.

Thank you for reaching out to us. The area that is of concern in the picture is the area to the side of the basketball hoop. I have circle this area in red. Is this tree lawn area one that is your neighbors responsibility or is it yours?

Also, some retraining for your person on the ground might be in order. We don't live out in the country. Property lines are QUITE obvious in our neighborhood.

BTW. The park accross the street, which is the HOAs responsibility, has at least 3 or 4 four dying trees in it.

I find them to be pretty useless.

Ya’ll do what you have to, but no way in heck am I going to allow someone to tell me what I can and cannot do on my own property. I understand the reasons for a HOA….but, no way.?

If I could afford some property I'd say the same thing.

Unfortunately almost all new builds in our area come with HOAs, or at the least covenants. Hopefully before I retire I can build a custom home on some property and be done with 'em.

This is the first (and last) time I will ever live in a HOA. After living 20+ years with 3 areas of privacy this is like living in Gestapo hell! Sure they're "supposed" to make your community a better place to live but not the one I'm on.

I keep my yard immaculate and when we get rain it doesn't take long for weeds to pop up from the heat. I'll go out and spray them and sure enough within a week I'll get a notice for weeds. But it's ok for my neighbor to have his boat hooked up to his pickup sticking half way into the street. He also has his commercial plumbing truck (HOA violation) parked in his driveway for the past 2 years. They're supposed to do weekly drive byes day and night looking for violations, they must of hired Hellen Keller!! When I question the HOA about this (I've even sent them pics) they tell me to file a complaint but if the homeowner asks who filed it they're obligated by AZ law to tell him. So I either get to look at Sanford & Son across the street or report him and wait for him to retaliate against me. :facepalm:
