This all goes back to a saying that not only I taught to my own children but will repeat in circumstances like this.

BTW I believe attempts at tort reform at the national level have failed, lawyers represent one of the top spending lobbyists at > $70m annually and a number of congressmen have legal degrees. Eventually like the estimated $90b in shoplifting and excessive gov regulations contribute to the cost of goods and in some cases make domestic production non competitive.

You're right, I haven't studied that case, and frankly, I don't have the time to sift through a bunch of legalese to figure out why an x00-page document could probably be reduced to 2.

Can you give us the Cole's Notes as to why she was justified? Am I wrong that she was driving with the coffee in her lap? On that alone, I say that she should be responsible for her own stupidity, but again, correct me if I'm wrong.
She wasn't driving, the car wasn't moving, and she required several surgeries and still didn't fully heal. Also McDonalds had been warned on multiple occasions that their coffee was dangerously hot - much more so than coffee you'd get at Starbucks or basically anywhere that commercially sells coffee.

If she had actually taken a drink it may have been worse.

there are WAY, WAY, WAY too many frivolous lawsuits.
for every 1 case dismissed, 10 are settled because its cheaper than taking it to court to get it thrown out.
Many years ago there was a push for "loser pays" to get rid of the frivolous lawsuits. If you file a claim now and you lose, it doesn't cost you anything. If you win the lawyer fees come out of the settlement. it's a no lose situation. If "loser pays the winners legal bill" were the law there'd be a hell of a lot less people trying to get a free payday. Maybe courts could go to a mediator to listen to both sides an offer a settlement before going to court. Once mediation fails loser pays kicks in.

As someone pointed out the biggest political donors are lawyers an their organizations. Plus two thirds of our politicians are lawyers....they're not going to kill the gravy train.
