Based on Ontario's Apology Act (https://www.ontario.ca/laws/statute/09a03) the use of "Sorry" cannot be used to make such a determination. Great question, though!

I've often thought that airlines should install platform scales at the ticket counter and or express check-in to weigh each passenger with their luggage together. Airlines use only a benchmark weight, which I believe is exceeded in many cases. Aircraft have a maximum takeoff weight which the Captain can only hope is ok each flight
Baggage is charged at a fixed rate regardless of its weight. luggage weighed at the point of manifesting could be charged at $XX/lb over a threshold or bracketed.
Weighing luggage and passenger together would save some embarrassment when checking in, and other passengers would not be able to see the numbers.
