If you look at the trees and the surrounding area, the lead car kept a steady rate of speed. I don't think that road-rager's insurance company could reasonably accuse the lead car of brake-checking. Road-rager pretty clearly sped up to ram him; there's only one person at blame from what's shown. That's not to say that lead didn't make a dick-move and cut off rager earlier, but I don't see brake-checking here.
